Welcome to AquaTrack: Daily Water Balance (the “App”), owned and operated by Pavel Turchenko, an Individual Entrepreneur based in Ukraine (“we,” “us,” “our”). We respect your privacy and are committed to protecting your personal information in compliance with applicable laws, including but not limited to the California Online Privacy Protection Act (CalOPPA), the General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA).
This Privacy Policy explains how and why we collect, use, store, and share your information when you use our App, as well as your rights and choices regarding your personal information.
2. Scope of This Privacy Policy
This Privacy Policy applies to all users who download, access, or use the App. By using the App, you acknowledge that you have read, understood, and agreed to this Privacy Policy. If you do not agree, please discontinue using the App.
3. Age and Eligibility
Our App is accessible to users of all ages, including individuals over the age of 3. If you are a parent or guardian of a child who is using the App, please ensure that the child understands this Privacy Policy. We do not knowingly collect personal information from children without parental consent. If you believe we have inadvertently collected information from a minor, please contact us at info@posterumsoft.com, and we will promptly delete it.
4. Information We Collect and How We Use It
(a) Information You Provide Locally on Your Device:
• Personal Data: You may enter information such as your age, gender, weight, and activity level. This data is stored locally on your device and is not transmitted to our servers or shared with third parties.
• Purpose: This information is used solely to calculate your daily water intake recommendations and improve your personal user experience.
(b) Automatically Collected Data (Analytics, Error Logs, Performance):
• Approximate Geolocation: We may collect non-precise location data to understand usage patterns and to improve our services. This data is not used to identify you personally.
• Usage and Interaction Data: We collect information about how you interact with the App, such as the screens you visit, the buttons you click, and the time spent on different features. This helps us understand user engagement and improve the user experience.
• Purchase Information: If you make in-app purchases or subscribe to any paid features, we may collect non-financial data related to the transaction (e.g., purchase confirmations) to analyze trends and enhance features and support.
• Crash and Performance Data: We collect error logs and performance metrics (through services like Bugfender or other analytics platforms) which may include details about your device model, operating system version, and other non-personally identifiable technical data.
• Purpose: We use these analytics, crash, and performance data to diagnose and fix technical issues, improve App stability, enhance user experience, and understand usage patterns.
• No Personal Identification: These logs and analytics data do not contain information that can directly identify you as an individual (e.g., no name, email, or unique user identifiers).
(c) Payment Information (Apple/Google In-App Purchases):
• We use Apple App Store In-App Payments and Google Play In-App Payments for subscriptions. We do not directly collect or store your financial information. All payment data is processed through Apple or Google’s secure payment systems, subject to their respective privacy policies.
5. How We Store Your Data
• Local Storage: Your entered personal data (age, gender, weight, and activity) remains on your device. You may update or change this information at any time within the App’s settings.
• Data Deletion: You cannot directly delete only the stored personal information from within the App (except by altering it), but you can remove all data by uninstalling the App. Upon uninstallation, all locally stored data is removed from your device.
6. Data Sharing and Disclosure
• No Sale of Personal Data: We do not sell, trade, rent, or otherwise share your personal data with third parties for marketing or advertising purposes.
• Service Providers: We may share non-personally identifiable information (such as technical error logs, usage statistics, or approximate geolocation) with third parties who provide analytics or error-logging services (e.g., Bugfender or similar). These service providers are contractually obligated to handle your data in a manner consistent with this Privacy Policy and applicable laws.
• Legal Obligations: We may disclose information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
7. International Data Transfers
As an Individual Entrepreneur from Ukraine, we may be subject to cross-border data processing restrictions. However, since we do not transmit your personal data to our own servers or third parties (other than anonymized/aggregated analytics and error logs), international data transfer is minimal or non-existent. Error logs and analytics data, if transmitted, may be processed in accordance with the respective providers’ policies. By using our App, you acknowledge and consent to any potential transfer of non-identifiable data as permitted by applicable laws.
8. Your Rights Under GDPR, CCPA/CPRA, and Other Privacy Laws
Depending on your jurisdiction, you may have the following rights:
• Right to Access: You may request a copy of the information we hold about you.
• Right to Rectification: You may request corrections to any inaccurate or incomplete information.
• Right to Erasure (Right to be Forgotten): You may request the deletion of your personal information. Since we do not store personally identifiable data on our servers, you can achieve this by uninstalling the App, thereby removing all locally stored data.
• Right to Restrict Processing: You may request that we limit how we use your data.
• Right to Data Portability: You may request to receive your personal information in a structured, commonly used, and machine-readable format, if applicable.
• Right to Object: You may object to certain uses of your personal data.
• Non-Discrimination: Under CCPA/CPRA, you have the right not to be discriminated against for exercising your privacy rights.
9. Security Measures
We take reasonable steps to protect your information, including using secure protocols for transmitting error logs and analytics data. However, no method of data storage or transmission over the Internet can be guaranteed to be 100% secure.
10. Third-Party Links and Integrations
Our App may contain links to third-party sites or services, such as Apple App Store and Google Play billing systems or Bugfender for error logging. This Privacy Policy does not apply to such third parties. We encourage you to review the privacy policies of any third-party services you use.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The most current version will be available within the App or on our website. Your continued use of the App after any changes indicates your acceptance of the revised Privacy Policy.
